The use of this members-only portion of the AzNMA web site constitutes agreement with the following additional terms and conditions:

The AzNMA maintains this portion of the web site (the “Members’ Site”) as a courtesy to those members of the AzNMA who may choose to access the Members’ Site (“Users”). The information presented herein is for informative purposes only. Unless expressly stated otherwise, the findings, interpretations and conclusions expressed in the materials on this Members’ Site are those of the various authors who prepared the work and do not necessarily represent the views of the AzNMA.

This Members’ Site is intended for use by licensed naturopathic physicians only. Users are responsible for their own decisions on diagnosis, treatment and follow up for a patient, or from choosing or not choosing specific treatments based on the posted publications. The content is not intended to diagnose patients or recommend therapy. Users should be aware that professionals in the field may have different opinions. Because of this fact and because of regular advances in medical research and the possibility of human error, Users should independently verify specified diagnosis methods, evidence, treatments, follow up and any contraindications or side effects, including whether a particular diagnosis, evidence, treatment or other follow up is generally appropriate, whether it is up to date and whether it is suitable for a particular patient. The content is no substitute for individual patient assessment based upon the User's examination of each patient and consideration of laboratory data and other factors unique to the patient.

Users should use their professional judgment in using the posted publications, which is done at their own risk. AzNMA relies on its authors to confirm the accuracy of the information presented and does not independently verify any of the information. Please also note that information is not warranted to be accurate and may be out of date. Ultimately it is the User’s responsibility to make his or her own professional judgments, so as to appropriately advise and treat his or her patients.

AZNMA TERMS AND CONDITIONS OF USE

By accessing or using any of the Arizona Naturopathic Medical Association (“AZNMA”) Internet sites including, without limitation, AZNMA.ORG, mobile websites, AZNMA profiles on social media sites and any other digital services operated or used by the AZNMA from time to time (collectively referred to as the "Sites") you agree to comply with and be bound by these Terms of Use ("Terms of Use"). Please read these Terms and Conditions of Use carefully.  If you do not agree to the Terms of Use you must immediately terminate use of the Sites. If you are under 18 years of age, you are not authorized to access or use the Sites.

CHANGES TO THE TERMS OF USE
AZNMA may revise and update these Terms of Use from time to time in its sole discretion. All changes are effective immediately when AZNMA posts them. Your continued use of the Sites following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page regularly.

OTHER TERMS AND CONDITIONS
Additional terms and conditions may also apply to specific portions, services or features of the Sites. All such additional terms and conditions (the “Additional Terms”) are hereby incorporated by this reference into these Terms of Use. To the extent the Additional Terms and these Terms of Use contain conflicting provisions, the provisions of the Additional Terms shall control with respect to such provisions.

ACCESSING THE SITES AND ACCOUNT SECURITY
AZNMA reserves the right to withdraw or amend the Sites, and any service or material AZNMA provides on the Sites, in its sole discretion without notice. AZNMA will not be liable if for any reason all or any part of the Sites is unavailable at any time or for any period.

To access the Sites or some of the resources they offer, you may be asked to provide certain registration details or other information. It is a condition of your use of the Sites that all the information you provide on the Sites is correct, current and complete. You agree that all information you provide to AZNMA, including but not limited to through the use of any interactive features on the Sites, is governed by our Privacy Policy https://www.aznma.org/home/privacy/ and you consent to all actions AZNMA takes with respect to your information consistent with our Privacy Policy.

If you choose, or are provided with, a user name, password or any other piece of information as part of AZNMA’s security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to the Sites or portions of them using your user name, password or other security information. You agree to notify AZNMA immediately of any unauthorized access to or use of your user name or password or any other breach of security.

AZNMA has the right to disable any user name, password or other identifier, whether chosen by you or provided by us, at any time in AZNMA’s sole discretion for any or no reason, including if, in AZNMA’s opinion, you have violated any provision of these Terms of Use.

CONTENT IS NOT MEDICAL ADVICE
The content of the Sites, such as text, graphics, images, and other material contained on the Sites ("Content") are for informational purposes only and the content is not medical advice. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay in seeking it or make any other health care related decision based on information published on the Sites!

PHYSICIAN CONTENT
The material contained on the Sites that is directed toward naturopathic physicians is offered as information only and not as practice, financial, accounting, legal or other professional advice. Users need to consult their own professional advisors for such advice. Business decisions, including decisions about method of practice, are personal choices to be made by individual physicians.

Information on the Sites provided as assistance for physicians making clinical decisions regarding the clinical care of their patients cannot substitute for the individual judgment brought to each clinical situation by the patient’s physician. As with all clinical reference resources, they reflect the science of naturopathic medicine at the time of their development, but they should be used with the clear understanding that continued research may result in new knowledge or recommendations.

Reliance on any information provided by AZNMA, AZNMA employees, others appearing on the Sites at the invitation of AZNMA, or other visitors to the Sites, is at your own risk. DISCLAIMER OF WARRANTIES
AZNMA DOES NOT MAKE ANY WARRANTIES EXPRESS OR IMPLIED WHATSOEVER AS TO THE OPERATION OF THE SITES, INFORMATION, CONTENT OR ANY OTHER PRODUCT, SERVICE OR EDUCATIONAL PROGRAM DISPLAYED ON THE SITES.

LIMITATION ON LIABILITY
IN NO EVENT WILL AZNMA, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITES, ANY SITES LINKED TO THEM OR ANY CONTENT ON THE SITES OR SUCH OTHER SITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. YOUR ACCEPTANCE OF THIS LIMITATION OF LIABILITY IS AN ESSENTIAL TERM OF THESE TERMS OF USE AND THE PARTIES ACKNOWLEDGE THAT AZNMA WOULD NOT GRANT ACCESS TO THE SITES WITHOUT YOUR AGREEMENT TO THIS TERM.

IF YOU ARE DISSATISFIED WITH THE SITES OR WITH THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITES. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES, OUR LIABILITY IS LIMITED AND WARRANTIES ARE EXCLUDED TO THE GREATEST EXTENT PERMITTED BY LAW.

INFORMATION CONCERNING MEDICAL MARIJUANA
The sites may contain information regarding the Arizona Medical Marijuana Act. This information is not legal advice or medical advice. It is provided solely for informational purposes only and is intended to apply only to the medicinal use of marijuana within the State of Arizona pursuant to the Arizona Medical Marijuana Act. The AZNMA does not endorse or oppose the Arizona Medical Marijuana Act and only provides information regarding the program. By agreeing to these Terms of Use, you acknowledge and understand that all patients, caregivers, physicians, dispensary agents or any other individuals involved in the medicinal use, distribution, or certification of qualifying patients for medicinal use of marijuana are required to comply with the legal requirements of the Arizona Medical Marijuana Act. USE OF THE SITES
You may use the Sites solely for your personal, noncommercial use, and may print Content only for personal or educational purposes, which must in each case be non-commercial.

PROPRIETARY RIGHTS
The content of the Sites includes, without limitation, (i) AZNMA trademarks, service marks, logos, brands, and brand names and other distinctive graphics (collectively "AZNMA Marks"); and (ii) information, data, materials, text, images, photographs, audio and video material, and artwork, and (iii) the design, structure, selection, compilation, assembly, coordination, expression, functionalities, applications, look and feel, and arrangement of any content contained in or available through the Sites (the items identified in subsections (i) (ii) and (iii) shall be collectively referred to herein as "AZNMA Content"). AZNMA Content is the property of the AZNMA, its licensors, sponsors, partners, advertisers, content providers or other third parties and is protected by law including, but not limited to, copyright, trade secret, patent, and trademark law, as well as other state, national and international laws, treaties and regulations. The reproduction, transmission, distribution, sale, publication, broadcast, circulation or dissemination of any AZNMA Content by you, or by you through any other person or entity, is prohibited unless express written consent is separately obtained from the AZNMA, or the owner of such content if the AZNMA is not the owner. Any use of the AZNMA Marks without AZNMA's express written consent is strictly prohibited. You may not alter, delete, obscure or conceal any copyright or other notices appearing in the AZNMA Content, including any such notices appearing on any AZNMA Content you are permitted to download, transmit, display, print, or reproduce from the Sites.

PROHIBITED USES
You may use the Sites only for lawful purposes and in accordance with these Terms of Use. You agree not to take any action that might compromise the security of the Sites, render the Sites inaccessible to others or otherwise cause damage to the Sites or their content. You agree not to add to, subtract from, or otherwise modify the content of the Sites, or to attempt to access any content that is not intended for you. You agree not to use the Sites in any manner that might interfere with the rights of third parties.

MONITORING AND ENFORCEMENT; TERMINATION
AZNMA has the right to: disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including but not limited to their intellectual property rights or their right to privacy; take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Sites; and terminate or suspend your access to all or part of the Sites for any or no reason, including without limitation, any violation of these Terms of Use.

Without limiting the foregoing, AZNMA has the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone using the Sites. AZNMA will not be liable or responsible to you or anyone else for performance or nonperformance of the activities described in this section.

COPYRIGHT INFRINGEMENT
If you believe a work you own that is protected by a U.S. copyright has been posted on the Sites without authorization, you may notify AZNMA through its copyright agent, by providing the following information:
a. A physical or electronic signature of the person authorized to act on behalf of the copyright owner;
b. Identification of the copyrighted work or works claimed to have been infringed;
c. A detailed description of the material you claim is infringing, together with information sufficient to enable AZNMA to locate it, including the URL where the infringing material appears;
d. Your name, mailing address, telephone number and e-mail address;
e. A statement by you that you believe in good faith belief that the copyrighted material identified is being used in a manner that is not authorized by the copyright owner, its agent or the law; and
f. A statement by you that the above information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright allegedly infringed.

These Terms of Use and all matters regarding your use of the Sites shall be governed by, construed in accordance with, and enforced under the laws of the State of Arizona without regard to choice of law principles.
